SDLT Refunds & Reclaims
If you've overpaid SDLT, you may be entitled to a refund. We've helped clients reclaim over £900,000 in incorrectly paid stamp duty. Find out if you can claim.
SDLT is frequently overpaid. Whether through incorrect property classification, failure to claim reliefs, or misapplication of the 3% surcharge, many property transactions result in SDLT overpayments. The good news is that overpaid SDLT can often be reclaimed through amendment of the SDLT return or a formal overpayment relief claim. We have helped clients reclaim over £900,000 in incorrectly paid SDLT.
Common Reasons for SDLT Overpayment
SDLT is most commonly overpaid in the following scenarios: properties incorrectly classified as residential when they should be mixed-use; failure to claim Multiple Dwellings Relief (for pre-June 2024 transactions); the 3% surcharge applied when it should not have been; failure to claim first-time buyer's relief; and the 15% rate applied to company purchases when an exemption was available. Many of these overpayments can be reclaimed.
Time Limits for SDLT Refunds
There are two main routes to reclaiming overpaid SDLT. First, the SDLT return can be amended within 12 months of the filing date — this is the simplest route. Second, if the amendment window has passed, a formal overpayment relief claim can be made under Section 80 of the Finance Act 1989, within four years of the end of the relevant tax year. This means transactions going back several years may still be eligible for a refund.
How We Can Help
We review property transactions to identify SDLT overpayments, prepare and submit amendment or overpayment relief claims, and handle all communications with HMRC. Our SDLT advisers have extensive experience in reclaiming overpaid SDLT, with total recoveries exceeding £900,000 for our clients. We work on a transparent fee basis and only charge for successful claims.
The Refund Process
The refund process typically takes 8-12 weeks from submission of the claim to receipt of the refund. For SDLT return amendments, HMRC has 21 days to process the amendment. For overpayment relief claims, HMRC may take longer and may open an enquiry into the claim. We handle the entire process from initial review to receipt of the refund.
